An arbitral award is the final binding decision issued by an arbitrator or arbitral tribunal at the conclusion of arbitration proceedings. It is the arbitration equivalent of a court judgment — it determines the rights and obligations of the disputing parties.
Under Section 36 of the Arbitration and Conciliation Act, 1996, once the period for challenging the award (3 months under Section 34) has expired without a challenge, the award is enforceable as a decree of the court.
Types of Arbitral Awards
Final Award
Decides all issues in the arbitration proceedings. Once issued, it ends the arbitration.
Interim Award
Issued before the final award to decide specific issues or grant interim relief during proceedings.
Partial Award
Decides some but not all issues in the arbitration. Remaining issues are decided in a subsequent award.
Consent Award / Agreed Award
An award reflecting the settlement agreed between the parties — issued by the arbitral tribunal to give it binding force.
Default Award
Issued when one party fails to participate in the proceedings, after the tribunal ensures proper notice was given.
Foreign Award
An arbitral award issued outside India, enforceable in India under the New York Convention (Part II of the Act).

→Court enforces as a decree — can attach assets, recover money
→Foreign awards enforceable under New York Convention
→Enforcement can be sought in any court with jurisdiction
Challenge — Section 34
→Must apply within 3 months of receiving the award
→Only limited grounds: incapacity, invalid agreement, natural justice violation, public policy conflict
→Court may set aside the entire award or a specific portion
→Setting aside does not mean the dispute is decided against the challenger
