Conciliation Meaning

Conciliation is a voluntary, confidential dispute resolution process in which a neutral third party — the conciliator — assists disputing parties in reaching a mutually acceptable settlement. Unlike mediation, the conciliator takes a more active role and may suggest settlement proposals to the parties.

In India, conciliation is governed by Part III (Sections 61–81) of the Arbitration and Conciliation Act, 1996. A settlement agreement reached through conciliation under Section 73 is final and binding on the parties — enforceable as an arbitral award on agreed terms.

Key Distinction: In conciliation, the conciliator may actively suggest settlement terms. In mediation, the mediator only facilitates — they do not propose solutions. This makes conciliation slightly more interventionist.

Conciliation Process

Initiation

A party files a request for conciliation. The other party must consent — conciliation is voluntary.

Appointment of Conciliator

Parties mutually appoint a conciliator, or Sandhee appoints from its panel of certified conciliators.

Preliminary Meetings

The conciliator meets each party separately to understand their positions, interests, and concerns.

Joint Sessions

Conciliator brings parties together, facilitates dialogue, and may suggest settlement proposals.

Separate Sessions

Conciliator meets parties separately, shuttling between them to bridge differences.

Settlement Agreement

When parties agree, the settlement is drawn up. Under Section 73, it is final and binding as an arbitral award.
